UPDATE:Special Counsel Jack Smith will appeal a judges order dismissing the classified documents case againstDonald Trump.
The Justice Department has authorized the Special Counsel to appeal the courts order.
U.S. District Judge Aileen Cannon issued the ruling today.

Trump had been charged with withholding documents and obstructing justice after he left the White House.

Her ruling is the latest bombshell in Trumps legal proceedings.
Last year, he faced four separate series of indictments in state and federal court.

Thomas went further, arguing that Justice Department special counsels are unconstitutional because they do not have congressional authorization.
Trump was convictedin a New York court in May on 34 counts of falsifying business records.
It also means additional delays in the proceedings.
